M&J Cadeau Gravés specializes in the manufacture, personalized engravings and online sales of objects for companies, associations, local authorities and individuals, with services in graphic design and laser engraving.


ARTICLE 1 – CHAMP D’APPLICATION

These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales made by M et J CADEAUX GRAVES www.mj-cadeaux-graves.com (“The Seller”) via its website, to consumers and non-professional buyers (“Customers or the Customer”), wishing to acquire the products offered for sale by the Seller (“The Products”):

– decorative items, photography, jewelry, key rings, bookmarks, and creative products in wood and other materials worked in engraving and laser cutting, by immediate purchase or by placing a personalized order, via the website.

They specify in particular the conditions of immediate purchase, ordering, payment and delivery or delivery of the Products ordered by the Customers.

The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented in the Seller's catalogues. ARTICLE 2: THE CUSTOMER

The customer declares to be a natural person, at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the site. ARTICLE 3: THE PRODUCTS

The characteristics appearing on the descriptive sheets of the products offered by M et J engraved gifts are established, among other things, for the materials used, from the data provided by our suppliers, subject to the validity of the information. M and J engraved gifts undertakes to provide the most faithful shots possible, but these may not ensure perfect conformity with the product. The photographs have no contractual value. For the engraved photographs as on the images of the site, the wood and its aspect can be visible. Product availability: The products marketed on the M et J engraved gifts site are manufactured on demand, after receipt and validation of payment for the customer's order. M and J engraved gifts undertakes to manufacture and then send the products as soon as possible. ARTICLE 5: THE ORDER

It is up to the Customer to select on the website “https://mj-cadeaux-graves.com” the Products he wishes to order. The order taking on the site is subject to compliance with the procedure set up by M et J engraved gifts materialized by a succession of different steps that the customer must imperatively follow to validate his order. Any order implies acceptance of the prices and descriptions of the products available for sale.

ARTICLE 6: PAYMENT

Payments are made by credit card or payment using the Stripe or Paypal payment module, which is completely secure. ARTICLE 7: DELIVERY

M et J engraved gifts uses the shipping services of the Post Office, by Letter Followed, Colissimo Domicile with or without signature. The average delivery time is 1 to 3 working days depending on the destination from the registration of the product by the postal services. Parcel tracking is operational on the delivery company's website at https://www.laposte.fr/particulier/outils/suivre-vos-envois. M and J engraved gifts reserves the right to revise its shipping rates at any time based on increases in postal and Colissimo charges billed to it by the Post Office.

    With Signature

Your package will be delivered to you within 48 hours after shipment, from Monday to Saturday, you must be present to sign receipt of your package.

If the address is incomplete or incorrect, the parcel will be returned to the sender without provision. Return shipping costs will be borne by the customer.


Once the package has been prepared by us, it will be delivered to you within an indicative period of 48 hours and you will be informed of the availability of your package by SMS and e-mail. The latter will give you your collection codes allowing you to collect your package for 3 working days. After this time, your package will be returned to us.


Mondial Relay :

Depending on the information recorded by the Customer, the recipient of the package will be notified of the arrival of his package by email and/or SMS.

If it is impossible to deliver the package to the Point Relais® of destination, MONDIAL RELAY may deliver it to the nearest available Point Relais® and notify the recipient. No reimbursement of the service can take place as a result.

Standard Discount:

The package is delivered to the recipient on presentation of an identity document and against digital signature on the Point Relais® terminal. The signature on the electronic terminal as well as its reproduction, are proof of the delivery of the package to the recipient and the parties recognize in this signature a legal value identical to that of a handwritten signature*.

Parcels are delivered to an agent of the recipient upon presentation of an identity document of the agent and an identity document of the recipient.

Secure delivery:

In some cases, depending on the offer subscribed to by the Customer, Mondial Relay will send the recipient of the parcel a digital code called "PIN Code", which the recipient or his representative must enter on the Point Relais® terminal. This provision exempts the recipient from presenting his identity document, or his Agent from presenting his identity document as well as that of the recipient. The Customer acknowledges that dialing the exact PIN Code is valid for recognition of the identity of the recipient. Parcels are available at Point Relais® for 7 days, this period being up to 14 calendar days depending on the constraints of the activity.

The Customer is informed by e-mail notification of the availability of his parcel in the Point Relais® drop-off, it will remain at his disposal there for 10 calendar days.

At the end of this period, the parcel will be sent by the Point Relais® of deposit to the Service Expertise of Mondial Relay, 9 avenue Antoine Pinay 59510 HEM. The package will remain available to the Customer at this address for 14 days. The recovery of the package is the responsibility of the Customer. After this 14-day period, Mondial Relay may freely dispose of the package.

SHIPPING TIMES

Mondial Relay will make every effort to deliver the parcels within an average of 3 working days from pick-up for delivery to a Point Relais® in mainland France. In the same way, for international deliveries in Point Relais® or at home (1st presentation of the parcel), Mondial Relay will make every effort to deliver the parcels within an average time of 3 to 6 working days depending on the destination.


DELIVERY TERMS

When the package is dropped off at the Point Relais® chosen by the Customer, Mondial Relay accepts the package by reading the barcode appearing on the label printed by the Customer. A numbered receipt will be given to the Customer for proof of deposit. After the Customer's electronic signature, an e-mail may also be sent to him on the e-mail address associated with his order, this being proof of deposit. This proof must be kept by the Customer until delivery of the package. ARTICLE 13: INTELLECTUAL PROPERTY

ARTICLE 14: GUARANTEES

Reimbursements for Products deemed non-compliant or defective will be made as soon as possible and at the latest within 30 days of the Seller's finding of the lack of conformity or the hidden defect.

Reimbursement will be made by crediting the Customer's bank account or by bank check addressed to the Customer.

No compensation can be requested apart from those provided for by the Consumer Code.

ARTICLE 15 – IMPREVISION

In the event of a change in unforeseeable circumstances at the time of the conclusion of the contract, in accordance with the provisions of article 1195 of the Civil Code, the Party which has not agreed to assume an excessively onerous performance risk may request a renegotiation of the contract. to its co-contractor. However, if the change in circumstances unforeseeable at the time of the conclusion of the contract was definitive or lasted beyond 2 months, the present ones would be purely and simply resolved according to the methods defined in the article “Resolution”.


ARTICLE 16 – FORCE MAJEURE

The suspension of the obligations can in no way be a cause of liability for non-execution of the obligation in question, nor induce the payment of damages or penalties for delay.

The performance of the obligation is suspended for the duration of the force majeure if it is temporary and does not exceed a period of 90 days. Consequently, as soon as the cause of the suspension of their reciprocal obligations disappears, the Parties will make every effort to resume the normal performance of their contractual obligations as quickly as possible. If the impediment is definitive or exceeds a period of 90 days, the present will be purely and simply resolved according to the methods defined in the article “Resolution”.


ARTICLE 17 – CANCELLATION OF THE CONTRACT

It is expressly agreed that the parties may automatically terminate this contract, without warning or formality, in particular in the event of non-performance or force majeure.
